Device Repair Service Agreement
This Device Repair Service Agreement ("Agreement") is entered into between Sell Phone Repairs ("Service Provider") and the paying customer ("Customer") effective as of the date of purchase.
- Service Description:
Service Provider agrees to repair the customer's faulty device as per the details provided by the Customer. The device will be sent to Service Provider via postal service for repair. - Liability and Limitations:
2.1 Service Provider shall not be held liable for any damage, loss, or theft occurring to the device during transit through postal services. It is the responsibility of the Customer to ensure proper packaging and secure shipment of the device.
2.2 Service Provider shall not be held responsible for any pre-existing issues or damages that were not identified by the Customer prior to sending the device for repair.
2.3 Service Provider shall not be held liable for any data loss that may occur during the repair process. It is the Customer's responsibility to backup and secure all data before sending the device for repair.
2.4 The liability of Service Provider for any claims arising out of or relating to this Agreement, including any warranties, shall be limited to the total amount paid by the Customer for the repair service.
- Payment:
3.1 The Customer agrees to pay the agreed-upon repair fees before the commencement of the repair service. The payment can be made through the designated payment method as specified by Service Provider.
3.2 In the event that the device cannot be repaired or if additional repairs are required, Service Provider will notify the Customer and discuss the available options, including the cost implications. The Customer will have the right to accept or decline the additional repairs.
- Turnaround Time:
Service Provider shall make reasonable efforts to repair and return the device to the Customer within the agreed-upon timeframe. However, delays may occur due to unforeseen circumstances or the unavailability of necessary parts. Service Provider shall inform the Customer in such cases. - Warranty:
5.1 Service Provider offers a limited warranty for the repaired device. The warranty period and terms will be provided to the Customer upon completion of the repair. This warranty shall not cover any damages caused by mishandling, accidents, or unauthorized modifications.
5.2 The warranty is non-transferable and will be void if the device has been repaired or serviced by any party other than Service Provider during the warranty period.
- Customer Responsibilities:
6.1 The Customer agrees to provide accurate and complete information regarding the device and its issues for repair. Service Provider shall not be held responsible for any delays or difficulties caused by inaccurate or incomplete information.
6.2 The Customer is responsible for removing any personal or confidential information from the device before sending it for repair. Service Provider shall not be held liable for any unauthorized access to or disclosure of such information.
- Governing Law and Jurisdiction:
This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of the United Kingdom. - Entire Agreement:
This Agreement constitutes the entire agreement between Service Provider and Customer regarding the repair service and supersedes any prior agreements or understandings, whether written or verbal.
